These official rules (“Official Rules”) apply to the “Turtle Wax Jam In The Van Sweepstakes” (“Sweepstakes”). The Sweepstakes begins on March 12, 2018 at 12:00:01 AM Eastern Time (“ET”) and ends on December 31, 2018* at 11:59:59 PM ET (“Sweepstakes Period”).

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. BY SUBMITTING AN ENTRY, YOUR ENTRY MATERIALS, AS DEFINED BELOW, MAY BE INCLUDED IN SPONSOR’S COMMERCIAL MATERIAL, AS WELL AS AT SPONSOR’S WEBSITE OR SOCIAL MEDIA PLATFORMS.

This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram. By submitting an Entry, you understand that you are submitting your information to Sponsor. By entering the Sweepstakes, each entrant waives, discharges and releases Instagram from any and all liability associated with the Sweepstakes. Employees, officers and directors of Turtle Wax, Inc, (the “Sponsor”), and its respective parent companies, subsidiaries, affiliates, divisions, advertising, public relations and promotion, event production, fulfillment and/or judging agencies, and related entities (collectively, the “Related Entities”), and their immediate family members (mother, father, brothers, sisters, sons, daughters, spouse, step-parents, step-children and step-siblings regardless of where they reside) and/or those living in the same household of any such individual, whether or not related, are not eligible to enter this Sweepstakes or win a prize.

HOW TO ENTER: VIA INSTAGRAM: To enter, you must: (i) have an active and non-protected Instagram account or sign up for a free Instagram account at www.instagram.com; (ii) spot the “Turtle Wax Jam In The Van” on the road or at any event and snap a photo of the Van (“Image”); and (iii) post the Image of the Van on Instagram using the hashtags #TurtleWaxJams and #Sweepstakes (i, ii and iii, individually referred to as “Entry” and collectively as “Entries”). An Entry must include the required Hashtags #TurtleWaxJams and #Sweepstakes to be eligible. Entry content will not be judged. By submitting an Entry via Instagram.com, each entrant consents to receive from the Sponsor a reply Instagram message and, if applicable, an Instagram direct message, or email notifying such entrant that he/she is a potential prize winner. Entrants via Instagram.com will be required to have a public account in order to accept an eligible Entry hashtag. Entries posted by a protected Instagram account will not be recognized. Entrants must have internet access and a valid Instagram account at the time of entry in order to participate. Each entrant is limited to one Entry per day per person/Instagram account. For purposes of these Official Rules, a “Day” is defined as the period between 12:00:00 AM ET and 11:59:59 PM ET the same calendar day. Duplicate Entries or multiple Entries made by an entrant in excess of the number allowed will be disqualified.

 

Entries may not contain, as determined by Sponsor’s sole discretion, any content that:

  • Is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; obscene or offensive;
  • Feature celebrities, public figures or animated characters;
  • Promotes irresponsible or excessive consumption of alcohol; promotes illegal drugs, tobacco, firearms/weapons, or any particular political agenda or message;
  • Defames, misrepresents or contains disparaging remarks about other people or companies;

Contains trademarks, trade names or copyrighted materials owned by others, except those owned by Sponsor for which Sponsor has provided entrant a limited license to use as it relates to the Sweepstakes;

  • Contains any personal identification, such as license plate numbers, personal names (other than just first name), email or street addresses;
  • Communicates messages inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
  • Contains competitive products of Sponsor; and/or
  • Violates any law or infringes upon the rights of any other person or company.

 

Sponsor reserves the right to monitor Entries prior to posting them on Sponsor’s social media platforms, including but not limited to Instagram. By entering this Sweepstakes, each entrant acknowledges that his/her Entry may be posted at Sponsor’s website or social media platforms, including but not limited to Instagram in Sponsor’s sole discretion. Sponsor has no obligation to use or post any Entry submitted by any entrant. The use of an Entry by Sponsor or any Related Entity does not have any effect on the winner selection process. Entries posted are the views/opinions of the individual entrant and do not reflect the views of Sponsor in any manner. By entering the Sweepstakes, each entrant grants Sponsor and the Related Entities a worldwide, irrevocable, exclusive, assignable, transferable, unqualified, unrestricted, royalty-free license and right to edit, modify, publish, use, reuse, distribute, display, copy and otherwise exploit the Entry or any part thereof (with or without the entrant’s name and city/state), and any materials based thereon or derived therefrom, in any manner and in any media (whether now known or later developed), for any lawful purposes whatsoever (noncommercial or commercial), including, without limitation, for use in the commercial packaging and point-of-sale materials, or for promotion, marketing or advertising of Sponsor, or any Related Entity, each of their respective brands and/or products in any medium (whether now or hereafter known) throughout the world in perpetuity without further permission, notification, consideration, or payment to the entrant, except where prohibited by law. In addition, each entrant forever waives in favor of Sponsor all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that may preclude the use of the Entry (or any part thereof) as granted herein, or require entrant’s permission to use the Entry (or any part thereof) for the purposes stated herein. By submitting your Entry, you warrant and represent that (i) your Entry is original work and was created solely by you, has not been previously published, and has not won previous awards,  does not incorporate any material owned by any third party; (ii) the use of the Entry as described herein will not violate any law or infringe upon the rights of any third party; and (iii) you have obtained permission from any person whose name or likeness is used in the Entry. If, in the sole discretion of Sponsor, the Entry violates any law or infringes upon the rights of any third party, is inaccurate, incomplete or irregular in any way, or otherwise does not comply with these Official Rules or is deemed inappropriate, the Sponsor may disqualify the Entry.

Any Entry that is submitted with the use of a robotic, automated or macro device will be void. All Entries become the property of the Sponsor upon submission and will not be acknowledged or returned and the Sponsor has the right to dispose of the Entries at Sponsor’s discretion. Use of a mobile device to participate in this Sweepstakes is not required. If you use a mobile device to enter or to post updates from Instagram, message and data rates may apply, and entrants will be solely responsible for any and all applicable charges. Please consult your wireless-service provider regarding its pricing plans. By submitting an Entry, entrant agrees to abide by the terms of these Official Rules, the decisions of the Sponsor and Related Entities, the Sponsor’s Privacy Policy available at https://www.turtlewax.com/privacy-policy,  and Instagram’s Privacy Policy.  

 

DIGITAL MILLENNIUM COPYRIGHT ACT: Once an Image is entered into the Sweepstakes, any such posting will be deemed made at the direction of the entrant within the meaning of the Digital Millennium Copyright Act and the Communications Decency Act. EACH ENTRANT REPRESENTS, UNDERSTANDS AND ACKNOWLEDGES THAT HE/SHE WILL NOT BE PAID FOR OR RECEIVE ANY FORM OF COMPENSATION OR ROYALTY (OTHER THAN THE PRIZE STATED HEREIN IF SELECTED AS A PRIZE WINNER) IN EXCHANGE FOR GRANTING SPONSOR THE NON-EXCLUSIVE LICENSE RIGHTS OR FOR ANY SUBSEQUENT USE OF SUCH IMAGE BY SPONSOR. If requested, Entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights Entrant is granting to use the Image.

 

SELECTION OF WINNERS/ODDS OF WINNING: There will be a total of 30 winners (each a “Winner” and collectively, the “Winners”) in this Sweepstakes, as follows: (a) one grand prize (“Grand Prize”) Winner; and (b) 29 weekly prize (“Weekly Prize”) Winners, with one Weekly Prize selected each Week (defined below) during the Sweepstakes Period. The potential Winners will be randomly selected (“Drawing”) by Sponsor in accordance with the terms herein. Each Drawing will be conducted by Sponsor or its representatives, whose decisions are final and binding in all matters relating to the Sweepstakes.

 

WEEKLY PRIZE DRAWINGS: The 29 Weekly Prize Winners will be selected by random Drawing from among all Entries received from the start of the Sweepstakes Period through the end of the applicable week. A Week is defined as the period between Monday and Sunday of each week during the Sweepstakes Period. Entries received and not selected in a previous Weekly Drawing will be rolled over into subsequent Weekly Drawings. The Weekly Drawings for each month during the Sweepstakes Period will take place within seven days after the end of the applicable calendar month, with the random selection of Weekly Prize Winners for each Week of the applicable calendar month taking place on or about the Drawing dates as set forth below:

 

Two Weekly Prize Winners for the month of March from among all Entries received through the end of the applicable Week in March: Drawing – April 6, 2018

Five Weekly Prize Winners for the month of April from among all Entries received through the end of the applicable Week in April: Drawing - May 4, 2018

Four Weekly Prize Winners for the month of May from among all Entries received through the end of the applicable Week in May: Drawing – June 8, 2018

Four Weekly Prize Winners for the month of June from among all Entries received through the end of the applicable Week in June:  Drawing – July 6, 2018

Five Weekly Prize Winners for the month of July from among all Entries received through the end of the applicable week in July: Drawing – August 3, 2018

Four Weekly Prize Winners for the month of August from among all Entries received through the end of the applicable week in August: Drawing - September 7, 2018

Five Weekly Prize Winners for the month of September from among all Entries received through the end of the applicable week in September: Drawing – October 5, 2018

 

GRAND PRIZE DRAWING: The Grand Prize Winner will be selected by random Drawing from among all eligible Entries received during the Sweepstakes Period. The Grand Prize Drawing will take place on or about January 7, 2019*.

 

Odds of winning a Weekly Prize depend upon the number of eligible Entries received from the start of the Sweepstakes Period through the end of the applicable Week. The odds of winning the Grand Prize depend upon the number of eligible Entries received during the Sweepstakes Period.  All Random Drawings will be conducted by an independent judging organization. Sweepstakes entrants agree to be bound by the terms of these Official Rules and by the decisions of the Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. All Weekly Prizes may not be awarded in the event an insufficient number of eligible Entries are received. Entries are subject to verification of eligibility and compliance with the terms of these Official Rules.

 

(29) WEEKLY PRIZES: The 29 Weekly Prize Winners will each receive the following Weekly Prize: one (1) custom “Jam In The Van” Festival Kit consisting of Turtle Wax products designated by Sponsor and one month-long Spotify® subscription. The approximate retail value (“ARV”) of each Weekly Prize is $46.

 

ONE GRAND PRIZE: The one Grand Prize Winner will receive the following Grand Prize: one trip for the Grand Prize Winner and one (1) guest (“Guest”) to attend a “Jam In The Van Session” at one festival designated by Sponsor in its sole discretion, to take place before September 30, 2019. The Trip consists of: (i) round-trip economy class air transportation (air carrier to be designated by Sponsor) between a major airport near Grand Prize Winner’s residence and a city designated by Sponsor for Grand Prize Winner and one Guest; (ii) two nights hotel accommodations at a hotel designated by Sponsor (one standard double occupancy room and tax only); (iii) two tickets to a “Jam In The Van Session” at a Festival designated by Sponsor; (iv) round-trip ground transportation between the airport and the hotel and between the hotel and “Jam In The Van Session” Festival for Grand Prize Winner and Guest; and (v) one five hundred dollar ($500) gift card to be used towards spending money and meals and delivered to the Grand Prize Winner prior to travel (i, ii, iii, iv and v, collectively “Grand Prize”). The ARV of the Grand Prize will not exceed $3,600. In the event a Grand Prize Winner lives within 180 miles from the designated “Jam In The Van” Festival city, Sponsor will provide the Grand Prize Winner and Guest with round-trip ground transportation between the Grand Prize Winner’s residence and hotel in lieu of the round-trip coach air transportation. The dollar value difference between the round-trip coach air transportation and ground transportation will not be provided to the Grand Prize Winner. In the event, for whatever reason, the “Jam In The Van Session” Festival is postponed or cancelled prior to or during the Trip, that portion of the Grand Prize will not be awarded and Grand Prize Winner will not receive any compensation in lieu of the postponed or cancelled “Jam In The Van Session” Festival. Alcohol is not included as part of the Grand Prize. Grand Prize Winner is responsible for any and all expenses and incidental travel costs not expressly stated as part of the Grand Prize, including but not limited to ground transfers between Grand Prize Winner’s residence and airport of departure, ground transportation not specified as part of the Grand Prize, meals and beverages, in-room charges (e.g., mini-bar, room service, telephone, internet, movies), gratuities, travel upgrades, baggage fees, and personal incidentals. Grand Prize Winner will be required to provide a valid major credit or debit card upon hotel check-in and all in-room charges including but not limited to those defined above will be charged to that Grand Prize Winner’s major valid credit or debit card provided. Grand Prize Winner and Guest must travel before September 30, 2019 or the Grand Prize will be forfeited. Airline tickets are subject to terms and conditions set forth in these Official Rules and those set forth by selected travel providers. Other material restrictions may apply. Sponsor and its representatives are not responsible for any fees or additional charges resulting from the Grand Prize Winner’s change(s) to itinerary or accommodations. Grand Prize Winner and Guest are solely responsible for obtaining all necessary travel documents (e.g. a valid U.S. driver’s license) prior to travel and the associated costs for these requirements. Grand Prize Winner and Guest must travel on the same flight itinerary and comply with all security requirements. If the Guest is a minor (under age 18), the Grand Prize Winner must be the Guest’s parent or legal guardian or have written permission from the minor’s parent or legal guardian to travel with Grand Prize Winner on the Trip. Sponsor, its representatives, and the Related Entities shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by any air carrier, hotel, or other transportation company or any other person providing any of these services and accommodations. Sponsor, its representatives and the Related Entities shall not be liable for any loss or damage to baggage. If the Grand Prize Winner becomes disabled or cannot otherwise fully enjoy the prize due to illness, Administrator and/or Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of the Grand Prize and no other compensation in lieu of the Grand Prize will be awarded. Grand Prize Winner and Guest are responsible for obtaining his/her own medical, travel, and life insurance and any associated costs. Grand Prize Winner will be required to supply Sponsor with his/her social security number for tax purposes. Grand Prize Winner will receive an IRS Form 1099MISC for the ARV of his/her Grand Prize. The ARV of the Grand Prize may vary based on itinerary and availability of airfare and hotel at time of booking and travel. All travel is subject to any and all restrictions instituted by the Federal Aviation Administration, the Department of Defense and/or the Department of Homeland Security, as required. Arrangements for the fulfillment of the Grand Prizes, including all travel arrangements, will be made by Sponsor or its representatives within 45 days after completion of the Grand Prize Winner notification process.  

 

PRIZE CONDITIONS: The total ARV of all prizes to be awarded is $4,934. All Winners will be solely responsible for any and all federal, state, and local taxes on prizes, as well as any and all expenses that may be associated with the acceptance and use of prizes, except as otherwise set forth in these Official Rules. No substitution, assignment, redemption for cash, or transfer of any prize permitted. Each prize has no cash value and must be accepted by the Winners as awarded. If an advertised prize cannot be awarded due to circumstances beyond Sponsor’s reasonable control, a substitute prize of equal or greater value may be awarded in Sponsor’s sole discretion. A Winner may waive his/her right to receive a prize. PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND EXPRESSED OR IMPLIED.

 

EVENT CONDUCT: Grand Prize Winner’s and Guest’s conduct will be under the supervision of Sponsor and its Event representatives (“Event Staff”) whose decisions are final and binding in all aspects relating to the exclusive “Jam In The Van Session Festival” (hereinafter, “Event”). The Grand Prize Winner and his/her Guest may be removed from Event premises at the sole discretion of the Sponsor or Event Staff for any reason at any time, including but not limited to the advice of the Event Staff, creating an unauthorized disturbance, interruption or unnecessarily rough physical contact, or for any unhealthy, unlawful, unsafe, or inappropriate act. If the Grand Prize Winner or Guest who in the opinion of the Sponsor or Event Staff is considered a physical or mental threat to the well-being of any of the other guest or attendee of the Event or Event staff, he/she may be removed from Event premises. Any act performed by the Grand Prize Winner or Guest defined by federal, state or local statute or ordinance as constituting a criminal act may result in removal from Event premises. At the sole discretion of the Sponsor and Event Staff, if the Grand Prize Winner or Guest uses profanity, or demonstrates any lewd or sexually suggestive gestures or full or partial nudity, the Sponsor shall have the right to remove that individual from Event premises. At the sole discretion of the Sponsor and Event Staff, if the Grand Prize Winner or Guest creates the potential for death, disability, injury and/or property damage during the Event, the Sponsor and/or the Event Staff, shall have the right to remove that individual from Event premises.

 

WINNER NOTIFICATIONS: Potential Winners will be notified on or about two business days from date of applicable Drawing stated herein. Potential Winners will be notified via Instagram message and, if applicable, email. Potential Winners will be required to provide Sponsor with a valid email address within 48 hours from date and time of the winner notification or that potential Winner may be disqualified. Sponsor will make two attempts to notify a potential Winner within the 48 hours. In the event a potential Winner does not respond to any such prize notification within 48 hours of the date of issuance, or declines a prize for any reason, a disqualification will result, and that prize will be forfeited and, at Sponsor’s sole discretion, an alternate potential  Winner will be randomly selected from among all remaining eligible Entries received through the end of the applicable Week if a Weekly Prize or all remaining eligible Entries received during the Sweepstakes Period if the Grand Prize. Potential Grand Prize Winner will be required to fully complete, sign and timely return an unaltered Affidavit of Eligibility/Liability Release provided by Sponsor, and, where lawful, an unaltered Publicity Release within five business days of prize notification. Potential Weekly Prize Winners will be required to return a Prize Verification Form and unless prohibited by law, a Publicity Release, within five business days from date of issuance. Failure to submit any identification required by Sponsor or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of a Prize (or any portion thereof) or prize notification as undeliverable may result in disqualification and prize forfeiture and, at Sponsor’s sole discretion and may cause an alternate potential Winner to be randomly selected from among all remaining eligible Entries received through the end of the applicable Week if a Weekly Prize or all remaining eligible Entries received during the Sweepstakes Period if the Grand Prize. Weekly Prizes will be delivered within 30 days following the completion of the Winner notification process.

 

WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an Entry, each entrant agrees to (i) be bound by these Official Rules, including all Entry requirements, and (ii) waive any and all claims against the Sponsor, and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of the prize (or any portion thereof) or any travel or activity related to the receipt or use of a prize (or any portion thereof). By entering this Sweepstakes, each entrant gives his/her express permission to be contacted by the Sponsor by telephone, email, or Instagram instant message for Sweepstakes purposes. Each Winner, by acceptance of a prize, grants to Sponsor, and each of their respective designees the right to publicize such prize winner’s name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law. Sponsor is not responsible for fraudulent calls, Instagram message or emails made to entrants not by Sponsor.

GENERAL CONDITIONS: Released Parties are not responsible for stolen, late, incomplete, incorrect, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, misaddressed, undelivered, mutilated or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; any error, omission, interruption, defect or delay in transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of a prize or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to entrants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. In the case of dispute regarding the identity of the entrant, the authorized account holder of the Instagram account used to enter will be deemed the entrant and must comply with these Official Rules. The authorized account holder is deemed to be the natural person who is assigned the Instagram account by Instagram. Sponsor is not responsible for any change of Instagram account information or email address and it is solely the responsibility of the entrant to notify Sponsor in writing if the entrant changes his or her Instagram account or email address during the Sweepstakes Period. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, and/or their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in its sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning the Grand Prize (or any portion thereof), and (ii) disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right, in their sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify the Winners and award the prizes by way of random drawing from among all non-suspect, eligible Entries received up to the time of such cancellation. Sponsor also reserves the right, in their sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

 

CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR AND/OR ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

 

GOVERNING LAW & JURISDICTION: The Official Rules and the Sweepstakes are governed by US law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in “Binding Arbitration” Section of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of Illinois, in the City of Addison.

OFFICIAL RULES: By participating in this Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding. The Sweepstakes will be run in accordance with the Official Rules, subject to amendment by Sponsor. You are providing Your information to Turtle Wax, Inc., (“Turtle Wax”) and the information You provide will only be used in accordance with the Turtle Wax Privacy Policy found at: https://www.turtlewax.com/privacy-policy.  To the extent of any conflict between Turtle Wax's Privacy Policy and these Terms of Use, these Terms of Use shall control with respect to Your Tips and Tricks submission.

 

By submitting any pictures, comments or video (“Your Content”), You grant to Turtle Wax and its respective parents, subsidiaries and affiliated corporations and their respective successors, assigns, licensees, officers, directors, employees and agents, without limitation, a perpetual, worldwide, irrevocable, royalty-free, transferable license to transform, edit, modify, reproduce, record, copy, exhibit, create, change, condense, derivative works from, distribute, transmit, publish, translate, broadcast, perform, merchandise, sublicense, delete in its entirety, adapt, display, or otherwise use Your Content with or without modifications, in any way in any form or medium whether now existing or later developed, without limitation and without any compensation to You. c) is obscene or offensive; endorses any form of hate or hate group; 
d) defames, misrepresents or contains disparaging remarks about other people, products or companies; 
e) contains any personal identification, such as personal names, or e-mail addresses; 
f) contains any unauthorized third party products or trademarks;
g) infringes the rights of any third party (living or deceased); and/or
h) violates any law or contains any computer viruses, worms or other potentially damaging computer programs or files.
